Aquí os dejamos las notas tomadas por Nati Knight, de Coalición, de la reunión informativa celebrada en la Embajada de España con la asistencia del Home Office y del DExEU.

Resumen del trabajo logrado por las Instituciones Españolas – Departamento Especial del Brexit. Lanzamiento de la Ventanilla Única el 29-03-2017, fecha de la firma del artículo 50, coordinada por Juan Duarte.
‘Los Ciudadanos primero’ no es simplemente un slogan, los ciudadanos no son moneda de cambio. Estos mismos sentimientos los comparte el Gobierno Británico. Con respecto al hito conseguido en diciembre del 2017, el Gobierno Español lo considera un paso positivo – se va por buen camino.
Ventanilla Única – Resumen de las actividades: Se han respondido a 1500 preguntas/dudas que cubren una amplia variedad de temas relacionados con servicios consulares, se han atendido 200 consultas telefónicas y 31 reuniones. Fomento de las comunicaciones con diferentes asociaciones españolas, Instituto Cervantes, Surviving Brexit, asociaciones profesionales y de negocios, grupos políticos, etc. Presentaciones fuera de Londres, Manchester, Birmingham, Leeds, etc.
Cooperación cercana entre los dos gobiernos con respecto al Settled Status: propuesta de que el sistema sea probado a través de grupos de usuarios con el propósito de mejorar los procedimientos administrativos.
Agradecimiento por la presencia de los Oficiales del Gobierno Británico en esta charla informativa, y la solicitud de organizar una charla similar en el Norte de Inglaterra.

Proceso gratuito y muy sencillos para aquellos que ya tienen el derecho a quedarse/nacionalidad
No se necesita el Comprehensive Sickness Insurance (ni siquiera para aquellos que no trabajan o están estudiando)
También sanidad y pensiones reciprocas desde ahora – se seguirá pudiendo acumular las contribuciones
Universidades de Educación Superior tratadas como ciudadanos del Reino Unido
Reconocimiento de titulaciones profesionales
Derechos de las familias garantizados – desde ahora mismo, incluyendo familiares directos

P – del grupo Surviving Brexit – 5 años fuera del Reino Unido y se puede volver sin problema – es confuso porque antes se podía acumular. ¿Hay un acuerdo final? Nada acordado hasta que esté acordado. Preocupación porque ha habido una diferencia en el enfoque. Falta de claridad con respecto a los criterios. Otras preocupaciones y quejas
P – de Ciudadanos – Duda: ¿enviar el pasaporte y cuándo?
Respuesta de Nick Dawes: Conversaciones con el grupo 3 million. Intentamos escuchar y creo que hemos progresado bastante, actualmente el acuerdo está siendo convertido en acuerdo legal.
5 años fuera del Reino Unido y se mantiene el Settled Status – hemos intentado reflejar lo mejor posible que algunos ciudadanos de la UE que residen aquí quieran volver a sus países por un periodo largo. El informe de diciembre es muy similar a un texto legal – publicaremos informes y notas técnicas explicando en detalle el proceso de solicitud del Settled Status – es una prioridad
Solicitudes rechazadas – las razones se basarán en lo que haya sido publicado, nada más.
Con relación a evidencia: si no hay registro de impuestos y cosas parecidas, la evidencia será específica a cada individuo
Enviar pasaportes por correo – se necesita una prueba de identidad. Estamos viendo diferentes formas de poder devolver los pasaportes lo antes posible – renovación del pasaporte británico es solo dos o tres días
Posibilidad de reclamar en el proceso voluntario – alguien más que estudie la evidencia – el rechazo no impide el poder volver a solicitar el Settled Status
También vamos a utilizar los datos que el gobierno tiene actualmente y a los que podamos acceder, pero no todos los datos están disponibles (puede que estén protegidos) o son válidos, por ejemplo, los datos de Council Tax no son válidos.
Actualmente tenemos un sistema de asistencia digital para la gente que solicite la residencia permanente, que incluye asistencia personal disponible en bibliotecas, y se puede extender a asistencia uno a uno si la persona es especialmente vulnerable
¿P – de Surviving Brexit – Hay una fecha para solicitar el Settled Status? ¿Y una serie de ‘qué pasa si’ preocupaciones, que pasa con los niños y como sabrán si tienen derecho a tener un pasaporte británico?
P- del PP – Después del Brexit, ¿un año cotizado en el Reino Unido contará en España? Nick Dawes, será posible por parte del Reino Unido, no puedo decir si será posible o no por parte de España
P – Investigador Universitario – Hay profesiones que requieren de movilidad geográfica (investigadores que trabajan en las universidades fuera del Reino Unido) y que tienen un problema a la hora de solicitar el Settled Status porque no tiene 5 años consecutivos de residencia en el Reino Unido – Nick Dawes: la evidencia mirará a completar esos intervalos. Alternativamente, los que no tengan 5 años consecutivos de residencia recibirán un settled status temporal para que puedan conseguir los 5 años
P – Una persona – ¿Durante cuánto tiempo tendremos Settled Status? ¿Qué pasa si hay un cambio de gobierno? Nick Dawes: compromiso obligatorio en la Ley Internacional – es un tratado.
P – una persona – relaciones donde una parte de la pareja trabaja en otro país comunitario, ¿cómo podrán encajar en el Settled Status? Nick Dawes – Provisión de reunión familiar – la relación será considerada como ya existente, por lo tanto, podrán unirse como Settled Status
P – de Marea Granate – En el supuesto que se rechace la solicitud de Settled Status, ¿se podrá reclamar a título individual a un tribunal internacional? Las personas podrían pedir al ECJ ayuda para su interpretación y esto será acatado por el Reino Unido, este será el caso durante ocho años, para entonces el Reino Unido considera que habrá suficiente ley. Es decir, durante ocho años el Reino Unido tomará debida cuenta de ECJ. La decisión de consular al ECJ es voluntaria. La decisión de consultar será en última estancia tomada por el tribunal británico.
P – de una persona del público – los españoles que vengan a trabajar al Reino Unido después del Brexit, ¿necesitaran una visa o permiso de trabajo como hace 47 años? Nick Dawes: el Reino Unido nunca se va a retirar de las relaciones
P – del PP - ¿habrá alguna diferencia entre países de la UE?
P – de Ciudadanos – Settled Status – 2 años para solicitarlo, ¿reciproco? – Ciudadanos británicos en la UE también tienen que solicitar el Settled Status?
P – de la comunidad de Veterinarios – Veterinarios en el Sector de Salud Pública – 95% del personal que inspecciona en mataderos son ciudadanos comunitarios - ¿Cómo se va a mantener este porcentaje? Nick Dawes: Veterinarios son una prioridad en la lista de profesionales
P – del PSOE – documento no reconocido por un miembro de Aduanas. ¿Por qué algunas personas han recibido una carta de la Primera Ministra? Nick Dawes – necesidad de ver el documento y hay gente que se ha registrado en una lista de distribución para recibir comunicaciones
P – de un empleado de línea área – Remarcó el bajo coste de solicitar la nacionalidad hace algunos años. Lamenta haber perdido esa oportunidad.
P – del PP – 2 años para procesar las solicitudes de 3 millones de ciudadanos comunitarios, ¿es posible? Preocupación que el Home Office no sea capaz de tramitar todas en ese periodo de tiempo
P – de Pilar – llegó al Reino Unido hace 57 años, mantiene su pasaporte español con sus apellidos españoles, pero tiene el apellido de su marido en el Reino Unido para banco, etc. ¿Con que apellidos aparece y cuáles tiene que utilizar, españoles o inglés? Nick Dawes: Antes de que el Reino Unido y España entraran en la UE – no tiene que solicitar el Settled Status puesto que tiene el derecho a permanecer en el Reino Unido indefinidamente
P – de un estudiante – su mujer vive y trabaja en el extranjero, ¿dónde tiene que pagar sus impuestos?
P – de un profesional médico – alrededor de 1,000 – ¿cuándo solicitamos la residencia permanente/Settled Status? Hasta ahora el consejo del Home Office ha sido no hacer nada hasta que la fecha para solicitar el Settled Status se decida – si se pide la residencia permanente ahora, habrá que solicitar el Settled Status más adelante

Response Nick Dawes: Close links with 3 million. Wee try to listen and we think that we have made significant progress, at present the agreement is being turned into a legal agreement.
5 year out of UK and still Settled Status –we have tried to reflect as best as possible that some EU citizens residing here might want to go back to their countries for an extended period of time
The Dec. report is very close to a legal text – we will publish papers, technical notes dealing with detail
Streamlining the application process – a priority
Rejected applications – reasons will be based on what has been published, nothing else.
Ref evidence: if not standard tax records and such like, evidence will be specific to the individual
Sending passports by post – need identity proof. Looking at ways to achieve fast turnaround – UK passport renewals now two or three days.
Appeal process in the voluntary scheme – someone else to look at the evidence – a refusal does not prevent another application
Also we will be using gov. data already available to us from gov. records but not all Data is available ( might be Data protected) or reliable, Council Tax records for example are not always reliable.
We already have an assisted digital service for people to apply which extends to personal assistance available in libraries and can extend to one to one support if the individual is particularly vulnerable
Q - from Surviving Brexit - Date to apply for settled status? And a series of ‘what abouts’ concerns, what about children how will they know that they are entitled to a British passport?
Q - from PP - Would a year contributed in UK after Brexit count in Sp? Nick Dawes, aggregation will be possible from UK side, can’t say re Sp side.

Researcher - Professions requiring mobility (researches working across Universities outside UK) conflict with 5 years continuous residence requirement prior to being able to apply for Settled Status – Nick Dawes: evidence will be looked at to fill the gaps. Alternative, people would be be given temporary settled status in order to accrue five year evidence for settled status.
Q – from individual - Settled Status How long for? What if there is a change of gov.? Nick Dawes: Binding commitment in International Law – It is a treaty.
Q – from individual - Relationships where partner works in other EU country, how will they fit into Settled Status? Nick Dawes: Family reunion provision– the relationship would be considered as an existing relationship therefore they would be able to join as Settled Status
Q – from Marea Granate – In case of rejection of Settled Status, would an individual be able to appeal to a supra international court? Individuals could ask the ECJ for guidance re interpretation and this would be heeded by UK, this will be the case for eight years by then the UK considers that there should be sufficient case law. So for 8 years the UK will take due regard of ECJ. The decision to refer to ECJ is a voluntary one. The decision to refer will ultimately be taken by the British courts.
Q – from individual - Spanish people coming to UK to work after Brexit – work permits/ visa? Like 47 years ago? Nick Dawes: UK will not be pulling up the drawbridge

‘Citiziens first’ Not just a slogan & Citizens, not a bargaining chip. Sentiments shared by the UK gov.
Regarding the milestone reached Dec 2017, the Sp. Government considered it a positive step - On the right track.
Ventanilla Única – Summary of activity: 1500 questions answered covering a wide range of subjects related to consular services,200 phone ‘phone calls responded to and 31 One to One meetings. Fostering of links with a wide range of formal and informal Spanish community associations, Instituto Cervantes, Surviving Brexit, professional and business associations, political groups etc. Presentations outside London, Manchester, Birmingham, Leeds etc
Close cooperation between two govs. Ref. Settled Status: proposed systems being testing via user groups with a view to improve administrative procedures.
Grateful for the presence of the British Gov. Officers here today and a ‘gentle’ plea to hold a similar event in the North.
